1. Acceptance of Terms
By accessing or using MoniSight ("the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Platform. These terms apply to all users — whether you are listing a service (a "Worker") or seeking a service (a "Customer").
2. Platform Overview
MoniSight is a local services marketplace that connects independent service providers with customers across Uganda and East Africa. The Platform facilitates discovery, booking requests, and communication between parties. MoniSight is not a party to any service agreement between Workers and Customers.
3. User Accounts
You must create an account to list services or submit booking requests. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it up to date.
4. Listings & Service Providers
Workers may list their services on the Platform subject to admin approval. All listings must accurately describe the services offered. MoniSight reserves the right to remove any listing that violates these terms, contains false information, or is deemed inappropriate. Workers are solely responsible for delivering the services they advertise.
5. Subscriptions & Payments
Workers must maintain an active weekly subscription (Standard or Premium) to keep their listings visible on the Platform. Subscription fees are charged in advance and are non-refundable once a billing period has started. Customers may browse and contact service providers free of charge. All payment transactions are processed securely via PesaPal.
6. Booking Requests
Customers may submit booking requests to Workers through the Platform. A booking request does not constitute a binding contract until the Worker explicitly accepts it. MoniSight is not responsible for the outcome of any booking, including but not limited to the quality of work, disputes between parties, or failure to complete a service.
7. Prohibited Conduct
You agree not to:
- Post false, misleading, or fraudulent listings or reviews
- Harass, threaten, or abuse other users
- Use the Platform for any illegal purpose
- Attempt to circumvent the Platform by conducting transactions off-platform to avoid fees
- Scrape, copy, or redistribute Platform content without written permission
8. Reviews & Ratings
Customers may leave reviews for completed bookings. Reviews must be honest, accurate, and based on genuine experiences. MoniSight reserves the right to remove reviews that violate these terms or are deemed abusive. Workers may not offer incentives in exchange for positive reviews.
9. Privacy
Your privacy is important to us. Worker phone numbers are used solely to enable WhatsApp and call contact functionality and are never displayed as plain text to other users. We do not sell your personal data to third parties.
10. Limitation of Liability
MoniSight provides the Platform on an "as is" basis. To the fullest extent permitted by law, MoniSight shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including any disputes between Workers and Customers.
11. Changes to Terms
MoniSight may update these Terms & Conditions from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised terms. We will notify users of material changes via the Platform.
12. Governing Law
These Terms & Conditions are governed by the laws of the Republic of Uganda. Any disputes arising from use of the Platform shall be subject to the exclusive jurisdiction of the courts of Uganda.
